The offer and sale of products on our website www.ballodasola.com are governed by these General Conditions of Sale.

The products purchased on www.ballodasola.com are sold directly by La Scarpa & Co. SRL (hereinafter referred to as La Scarpa ), with registered office in Via Marecchia 27, Novafeltria (RN), 47863; registered Company Reg., Tax Code/ VAT No. 04347260400.

Sale

The Seller offers the products for sale on www.ballodasola.com and carries out its e-commerce activity exclusively for end users.

The Seller reserves the right not to process orders from subjects other than end users and in any case to orders that do not comply with its commercial policy.

How to buy

To purchase one or more products on www.ballodasola.com it is necessary to choose the product (model, size, colour) and fill in the order form in electronic format (personal data, billing and shipping). The transmission to the Seller, electronically, is automatic.

The order form contains a reference to the General Conditions of Sale (this page) and a summary of the information on the essential characteristics of each product ordered and the relative price (including all applicable taxes or duties), the means of payment that you can use to purchase each product and the methods of delivery of the products purchased and the related shipping costs.

The contract is considered concluded when the Seller receives your order form electronically, after verifying the correctness of the data relating to your order.

The order form will be filed in our database for the period of time necessary to process the orders and in any case in accordance with the law.

Once the contract is concluded, La Scarpa will process your purchase order.

The Seller may not process your purchase orders which do not give sufficient guarantees of solvency or which are incomplete or incorrect or in the event of unavailability of the products.

In these cases, we will inform you by e-mail that the contract has not been concluded and that the Seller has not processed your purchase order, specifying the reasons.

If the products presented on www.ballodasola.com are no longer available or on sale at the time of your last access to the site or the sending of the order form, it will be the Seller's responsibility to notify you promptly and in any case within 30 days to from the day following the one in which you have sent your order to the Seller, the possible unavailability of the products ordered. In case of forwarding of the order form and payment of the price, the Seller will reimburse any amount already anticipated by you.

By submitting the order form electronically, you unconditionally accept and undertake to observe these General Conditions of Sale and the Privacy Policy in relations with the Seller. If you do not agree with some of the terms contained in the General Conditions of Sale, please do not submit the order form for the purchase of products on www.ballodasola.com

Once the contract is concluded, the Seller will send you, via e-mail, a receipt of the purchase order, containing a summary of the information already contained in the order form (the information relating to the essential characteristics of the product and the detailed indication of the price , means of payment and delivery costs).

Products and Guarantee of authenticity

On www.ballodasola.com only branded products are offered for sale that La Scarpa purchases directly from carefully selected fashion houses, manufacturers and retailers and then customizes with artisanal manual processing. Therefore they are to be considered limited edition products and tailor-made for the final customer. The Seller does not sell used products, the manual manufacturing process and finishes (including ageing/wear) are part of the product that is sold as such. The manual processes make the product unique, therefore it may differ from the product images presented on the site. The essential characteristics of the products are presented on www.ballodasola.com within each product sheet. The images and colors of the products may not correspond to the real ones due to the Internet browser and monitor used.

Product prices may be subject to updates. Make sure of the final sale price before submitting the relevant order form. Purchase requests from countries not included among those displayed on the order page cannot be accepted by the Seller.

The Guarantee of authenticity of these products is offered directly by La Scarpa .

 

Conditions for the return and exchange of goods

Each item sold by La Scarpa on www.ballodasola.com is packaged and personalized to measure for the purchasing customer at the time the order is placed. It is therefore not possible to make a return but only to change the number of the goods.

The exchange can only be made with a different size of the same purchased item. The change can only be made once.

The deadline for making the exchange is 14 days from the date of receipt of the goods.

 The costs for changing the goods are charged to the customer and amount to 20 Euros per pair of sneakers (return shipping) valid for all customized sneakers models and 10 Euros for BalloDaSola personalized sandals.

It is necessary that the goods are completely intact in the original packaging and that the purchase receipt is inserted inside the box.

IMPORTANT:

To exchange goods, you need to contact us on 0541 920480 or write an email to ordini@ballodasola.com with the subject “Change goods Order number ...” to reserve the item you want as a replacement.

The shipment for the return of the products and the shipment of the new product is charged to the customer and amounts to Euro 12 (return shipment). For other EU countries, the costs will be quantified at the time of the exchange request.

Upon receipt of your exchange request, instructions will be sent to you to pay the return shipping costs (12 Euros). Once payment has been received, the goods will be collected from your address by our courier, and after having examined the integrity of the product, the exchange ordered by you will be sent.

We also recommend inserting a sheet inside the package with the following data indicated: name, surname, telephone number, shipping address to which you wish to receive the goods and model and shoe number reserved for the exchange.

Payments

For the payment of the products and the relative shipping and delivery costs, you can follow one of the methods indicated in the order form, typically credit card, paypal, bank transfer or cash on delivery - in the latter case, valid only for Italy and on orders of less than 200 Euros, additional collection costs of 7€ are added. The sum must be paid to the express courier in cash.

In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiry date) will be forwarded, via encrypted protocol, to the reference bank, which provides the related payment services remotely, without third parties having access to it in any way. This information entered directly on the bank portal is not stored in any way by the seller and is used only to complete the procedures relating to your purchase and to issue the relative refunds in the event of any product returns, following the exercise of your right to withdrawal, or if it is necessary to prevent or report the commission of fraud to the police.

The price for the purchase of the products and the shipping and delivery costs, as indicated in the order form, will be charged to your current account when the purchased products are shipped and not when the order is placed. Any customs fees are the responsibility of the buyer.

Shipping and delivery of products

The products for sale on www.ballodasola.com are delivered in Italy and throughout Europe.

The delivery of products available in stock is normally carried out within 48 hours (Italy) from the time of shipment. Longer times are expected for delivery to the islands or abroad. In this case please contact info.ballodasola@gmail.com for further information.

When the courier delivers, the customer and/or consumer must verify that the package is intact, not damaged or wet and in any case compliant with the standard characteristics of a package. Any disputes must be immediately raised to the carrier, in the absence of these, the product is considered delivered correctly.

From the moment they receive the damaged goods or request their return to the carrier, the consumer and/or customer has direct and exclusive action against the carrier itself. The latter is also responsible for the delay in delivering the goods to the recipient.

In such cases, La Scarpa must consider itself exempt from any liability for loss or damage to the goods from the moment in which the same is delivered without reservations to the carrier for transport.

Shipping fees

Italy: free for purchases over €100.

Abroad: free for purchases over €300.

Right of withdrawal

The products for sale on www.ballodasola.com are made to measure and clearly personalized by hand at the time of confirmation of the purchase order. They therefore fall into the category of goods for which the right of withdrawal is not provided (Article 59 of the Consumer Code).

Warranty

The consumer User has the right to a guarantee on the conformity of the products and services purchased. The warranty has a duration of 24 months starting from the delivery of the goods and the lack of conformity must be communicated to the Owner within 2 months of discovery.

To exercise the warranty right, the User must send an e-mail to the Owner indicating the order number and an accurate description of the defect (it is advisable to also attach photographic material). All elements are essential and will be verified by the Owner before responding to the User.

If the lack of conformity of the product is ascertained, the User has the right to obtain, after returning the defective product to the Owner, its repair or replacement. The User also has the right to ask the Owner for a reasonable price reduction or termination of the contract if the repair and replacement prove impossible or excessively onerous, the Owner has not repaired or replaced the goods within a reasonable time or the replacement or repair previously carried out has caused significant inconvenience to the User.

To exercise the right of guarantee and for further information in this regard, the User must contact the Owner.

Buyer's obligations

It is forbidden for the purchaser to enter false and/or fictitious data in the registration procedure necessary to activate the procedure for the execution of this contract and the further relative communications; the personal data and e-mails must be exclusively one's real personal data and not of third parties or fantasy.

The consumer and/or customer authorizes La Scarpa and undertakes to supply, at the discretional request of the latter, copies of unexpired identity documents.

Failure to fulfill the request for documents authorizes La Scarpa to terminate the contract due to breach by the buyer.

The customer releases La Scarpa from any liability deriving from the issue of incorrect tax documents due to errors relating to the data provided by the Customer, the Customer himself being solely responsible for the correct entry.

Once the online purchase procedure has been completed, the customer undertakes to print and keep these general conditions, which he will have already viewed and accepted as an obligatory step in the purchase, and to print the specifications of the product being purchased.

The guarantee of the successful completion of the payment that the customer makes with the means indicated above, is of an essential nature, so that by express agreement, the customer's failure to comply with this obligation will determine the legal termination of the contract without the need for a judicial decision, except the right of La Scarpa to take legal action for compensation for further damage.

Applicable law and dispute resolution

The General Conditions of Sale are governed by Italian law and in particular by the legislative decree 6 September 2005 n. 206, on the consumer code, with specific reference to the legislation on distance contracts and by the legislative decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce. In the event of disputes between the Seller and each end user, the competent court is that of Rimini.

Notes on product care and washing

For shoes with glitter, leather, studs and embroidery, wash delicately in cold water, avoiding rubbing directly on delicate accessories or fabrics. DO NOT MACHINE WASH

Do not leave the shoes soaked or damp, dry the inside and outside of the shoe using a hair dryer.

We use metal components subjected to anti-rust treatment, but this does not guarantee the non-appearance of rust if the shoes are wet and/or left exposed to humidity for a long time. For hand painted shoes with graffiti do not wash them by immersing them in water but use a damp cloth and clean them gently. DO NOT MACHINE WASH
